Terms of Service
These terms govern access to and use of Kinetic Mandate, provided by Kinetic Digital Partners Inc. By accessing the platform you agree to them. This is a working version pending final review by counsel.
1. The service
Kinetic Mandate is a software workspace for tracking enforcement and recovery matters. It is a tool for licensed professionals and does not provide legal advice or perform legal services.
Access is provided on a subscription basis, priced per active matter as described at the point of purchase.
2. Accounts and access
You are responsible for the accuracy of the information you enter, for safeguarding account credentials, and for the activity of users you authorize.
Access is granted by invitation and may be suspended for non-payment or misuse.
3. Your data
You retain ownership of the matter data you enter. You grant Kinetic Digital Partners Inc. a limited license to process that data solely to operate the service for you.
You are responsible for ensuring you have the right to enter and share any information you place in the platform, including with clients through the progress view.
4. Acceptable use
You agree not to misuse the service, attempt to access other tenants' data, or use the platform for any unlawful purpose.
5. Fees
Subscription fees are billed per active matter per month and are charged through the platform's payment processor. Fees are non-refundable except where required by law.
6. Disclaimers and liability
The service is provided on an as-is basis. To the fullest extent permitted by law, Kinetic Digital Partners Inc. disclaims implied warranties and limits its aggregate liability to the fees paid in the prior twelve months.

These terms may be updated; material changes will be communicated to account owners. Questions may be directed to your Kinetic point of contact.
